Service Description

Ship a Postcard LLC provides a digital software interface for AI image generation. The purchase of credits entitles the user to generate digital assets and, optionally, to trigger a physical fulfillment service via our logistics partners. Users acknowledge that while the digital asset is generated immediately, physical delivery is subject to third-party postal carrier conditions

Ship a Postcard LLC acts as an interactive computer service provider under 47 U.S.C. § 230. We are not the publisher of user-generated prompts or images.

1. Acceptable Use & Content Moderation

You agree not to use Ship a Postcard LLC to generate or transmit any content that is illegal, harassing, libelous, defamatory, or violates the privacy rights of others. Prohibited content includes, but is not limited to:

This agreement is between you and Ship a Postcard LLC, a limited liability company formed in the United States. By using our services, you agree to these terms.

Payments are processed securely via Stripe. By using our service, you agree to be bound by the Stripe Services Agreement.

  • True Threats: Content containing threats to injure the person, property, or reputation of any individual.
  • Harassment: Material intended to intimidate, stalk, or abuse recipients.
  • Likeness Violations: Use of a public figure's or private individual's likeness (photorealistic images/voice) without consent in ways that confuse authenticity.
  • Hate Speech: Communications originating from or supporting hate groups.

Right to Refuse: We reserve the right to cancel any order that violates our content moderation policies without a refund.

2. Sender Identity & Cooperation with Law Enforcement

  • Anonymity Policy: While we allow users to choose whether their name is explicitly printed on the postcard, the physical return address will default to "Ship a Postcard".
  • Legal Disclosure: Ship a Postcard is not a tool for anonymous harassment. We will cooperate fully with law enforcement and disclose your identity, IP address, and transaction details in response to valid legal processes (e.g., subpoenas or warrants) involving alleged violations of 18 U.S. Code § 875 (Interstate Communications) or § 876 (Mailing Threatening Communications).

3. AI Copyright & Intellectual Property

  • User Ownership: In accordance with OpenAI’s terms, you own the creations generated via GPT-Image-2 on our platform. However, note that purely AI-generated works may lack human authorship and thus may not be eligible for U.S. Copyright Office registration.
  • Limited License: By using this service, you grant Ship a Postcard LLC and its fulfillment partners (e.g., Lob.com) a non-exclusive, worldwide, royalty-free license to reproduce, print, and transmit the generated image solely for the purpose of fulfilling your order.
  • Third-Party Rights: You represent that your prompts do not infringe upon the intellectual property or Right of Publicity of any third party.

4. Limitation of Liability (Section 230 "Safe Harbor")

  • Third-Party Content: Ship a Postcard acts as an "interactive computer service" under 47 U.S.C. § 230. We are not the "publisher" or "speaker" of user-generated prompts or images and are immune from liability for content provided by users.
  • Service Risks: The service is provided "as is." We are not liable for delays caused by the USPS once the postcard is in their possession.
  • Check our shipping policy for more details at https://shipapostcard.com/shipping.

5. Law Enforcement Cooperation & Identity Accountability

  • Zero Tolerance: We do not allow our services to be used for threats, intimidation, or harassment. We monitor and enforce these policies through automated and manual review processes.
  • Disclosure of Identity: While we offer features to hide your name on the physical postcard, we maintain a complete record of your identity, including your name, email, payment details, and IP address.
  • Mandatory Cooperation: Ship a Postcard LLC will cooperate fully with law enforcement and the U.S. Postal Inspection Service. We will disclose your identity and transaction history in response to a valid court order, warrant, or subpoena involving alleged violations of federal or state laws, including 18 U.S.C. § 875 (Interstate Communications) and § 876 (Mailing Threatening Communications).

6. Limitations of Automated Moderation

  • Moderation Rights: We utilize automated tools provided by OpenAI to analyze content for nudity, sexual content, gore, violence, hate symbols, and illegal drugs.
  • Reservation of Rights: While these systems are designed to detect and reject prohibited material, their approval does not constitute a guarantee that the content is legal or compliant with USPS regulations.
  • Manual Overwrite: We reserve the right to manually reject any order that we reasonably believe violates our safety standards, even if it passes automated filters.
  • Refunds for Violations: Orders rejected for policy violations—regardless of automated approval status—are handled according to our Refund Policy and may not be eligible for a refund if they involve illegal activities.

7. Taxes

Prices displayed on the platform do not include sales tax. As Ship a Postcard LLC is a Delaware-domiciled entity, no state sales tax is currently applied to transactions. However, users are responsible for any use tax or local taxes that may apply in their specific jurisdiction.
